
Article 5 of the Water Act no 7/2004 recognizes the right to water for basic individual daily need of water for everyone. However, there is no other provision in the Water Act that elaborates on how the right should be exercised. Consequently, in enforcing the right to water, people need other legal instruments. This research focuses on the alternative legal instruments which are available to be employed in enforcing the right to water. The Right to water which is believed as part of the right to life should be found in many human rights legal documents so that the research will analyze on how the human rights instruments in Indonesia will play a dominant role to enforce the right to water rather than the Water Act itself which explicitly mentions that right.
